Special Edition: CJEU Decision on GDPR Damage Claims

On 4 May, 2023, the Court of Justice of the European Union will announce its long-awaited judgment on damage claims for violations of the EU General Data Protection Regulation (case 300/21 – Österreichische Post). This judgment will, especially, have a huge impact on the right to claim compensation for non-material damage which a person may have suffered as a result of an infringement of the GDPR in accordance with Art. 82 GDPR. Decisive prerequisites for such a claim have not been clearly regulated in the GDPR and must now be decided by the court, such as:
- Is the mere infringement of the GDPR in itself sufficient for the award of compensation, or in other words: Is there a claim to compensation without a damage?
- Does the GDPR cover punitive damages?
- Is it sufficient that the infringement causes upset or is it necessary that it causes more severe consequences?
- What are relevant criteria for the assessment of the compensation?
In this special edition of the “GDPR Deep Dives”, Dr Flemming Moos and Dr Jens Schefzig, leading experts in the field of data protection and privacy, will analyse this judgment and explain the practical consequences of the judgment for companies. They will also give recommendations on how companies can best prepare and defend themselves against such claims for damages.
