Osborne Clarke assisted Gi Group S.p.A., an Italian multinational, leader in the staff leasing sector, in two sets of proceedings brought by two employment agencies which had challenged the decision to award, in favour of Gi Group, the procedure for the assignment, by IN.VA. S.p.A. - as the contracting authority for the Autonomous Region of Valle d'Aosta - of the temporary staff leasing services for the Valle d'Aosta Health Authority.
The Regional Administrative Court of Valle d'Aosta, which had already rejected the claimants' requests during the interlocutory proceedings, rejected all the claims made regarding the verification of the alleged anomaly in Gi Group's bid as carried out in the ambit of the procedure, and the stages of evaluation of the technical bids as carried out by the Tender Commission. The decision is particularly important given the legal issues dealt with, which are of great interest for the area of public tenders, but also because it allows Gi Group to consolidate its position as leader in the supply of labour in the healthcare sector, through a 5-year contract for a base amount of over Euro 28 million.
