Osborne Clarke - with a team led by partner Enrico Fabrizi, assisted by senior associate Valeria Veneziano and lawyer Federica Ibba - represented Credito Emiliano S.p.A. (Credem) in the investigation proceedings before the Italian Antitrust Authority in relation to the project, submitted by Bancomat S.p.A., to modify the remuneration model for ATM withdrawals with Bancomat circuit cards.
The Associazione Banche Private Italiane - Pri.Banks (assisted by Massimo Condinanzi and Eleonora Ghiretti), Assopopolari (assisted by Fabrizio Maimeri) and Casse di Risparmio di Asti, Bolzano, Fossano, Savigliano and Volterra (assisted by Paolo Ziotti) also intervened with Credem in the proceedings.
Altroconsumo (a major consumer organisation, assisted by Giorgio Afferni) also submitted its comments.
At the end of a complex investigation, the Italian Antitrust Authority, in line with the comments received from Credem and the other intervenients, concluded that the new project constitutes a restriction of competition as it establishes a set of common rules that give rise to anti-competitive effects.
