Rights to Light and Rights of Access – Neighbourly matters

Building facade

In the latest instalment of our property disputes webinar series, we will be turning our attention for the first time to neighbourly matters focussing on rights of light and rights of access.

Victoria Woolf and Shinead Wilson from our real estate disputes team will be covering some neighbourly issues that developers are commonly faced with and practical tips for dealing with them, including:

Risk Mitigation in Rights to Light (RTL) Matters:

  • what to do to avoid RTL pitfalls on an acquisition,
  • developers conduct,
  • RTL claims and insurance, and
  • section 203 appropriation.

Rights of Access:

  • criteria for utilising the Access to Neighbouring Land Act (Developer's conduct and how the Party Wall Act 1996 can help with access rights), and
  • access points to consider on acquisition.
