The dynamic economic changes pose new, unknown challenges for entrepreneurs. When carrying out complex, intricate investment, technological or transactional projects, companies often encounter conflict situations that require a speedy solution that would allow them to achieve their goals and minimise their losses. This implies the need to react quickly and effectively to problems as they arise, and to manage the process in a comprehensive way to ensure that the company is safe and protected against adverse consequences.

In response to clients’ expectations, Osborne Clarke is strengthening its dispute resolution practice. Starting in October 2022, the Dispute Resolution Team will be headed by Marcin Robenek, an attorney with many years of experience in handling multi-million-dollar worth infrastructure and post-transaction disputes as well as disputes relating to project implementation and IT projects.

Marcin handles proceedings before General Courts, the Supreme Court, the ICC International Court of Arbitration in Paris, the Arbitration Court of the National Chamber of Commerce in Warsaw, and before arbitration tribunals appointed in accordance with the UNCITRAL Rules.

His experience includes several years of support for clients as part of renowned litigation practices of leading Polish law firms, and previously three years of practice in the District Court and the Regional court.
"I approach each case individually, supporting the client at every stage of the dispute - from securing his interests when the dispute is just beginning to arise, through the preparation of comprehensive procedural tactics taking into account the conditions of his industry and the specificity of the case, to the representation of his interests at the stage of pursuing a claim," - says Marcin Robenek.

In addition to Marcin Robenek, the Dispute Resolution team includes Bartłomiej Sadura (Senior Associate), Wiktor Rustecki (Associate), and Paulina Lekan (Junior Associate).

Bartłomiej Sadura has many years of experience in handling commercial disputes and debt restructuring cases, as well as debt collection cases and payment bottlenecks. He represents clients from various industries in civil, administrative, and criminal proceedings. He focuses on insolvency cases, supporting both creditors and debtors in restructuring and insolvency proceedings. He has handled a number of complex restructuring proceedings and insolvency disputes, and has represented entrepreneurs in civil insolvency proceedings.

Wiktor Rustecki specialises in commercial disputes. He also advises on competition law and regulatory aspects of insurance. He represents clients before General Courts and the Supreme Court, as well as before central authorities and Administrative Courts, mainly in economic disputes. He provides day-to-day legal services to entities from the leasing and insurance industry, advising, inter alia, on general contractual terms and conditions and terms of distribution of insurance products. He supports clients in cases before the President of the Office of Competition and Consumer Protection and in matters relating to distribution contracts and selective distribution, as well as in and other competition law issues.

Paulina Lekan supports clients in commercial disputes and debt recovery proceedings. She advises in civil law cases and in cases relating to the Act on Property Ownership. She is also experienced in handling family cases.
