Dr Bettina Enz is a Berlin-based Counsel of Osborne Clarke’s white-collar team. Bettina specializes in internal investigations and is an expert in advising providers of digital services on all matters related to German criminal law.
Bettina's extensive experience in advising tech companies on German criminal law includes, inter alia, in the field of social media, assessing user content under criminal law and identifying liability risks of providers of digital services. With regard to requests for information from German law enforcement authorities on user data, Bettina examines on behalf of affected companies the legitimacy of such data access and data transfer and handles for clients the entire process of communication with the authorities. Interdisciplinary and cross-border legal issues are core competencies of Bettina’s practice in that area.
Furthermore, Bettina’s expertise focuses on preparing, performing and evaluating internal investigations when there is suspicion that a criminal or an administrative offense has been committed within a company. Together with her team, she helps clarifying the facts of the case by preparing and conducting interviews in a structured manner, carrying out on-site inspections and assessing potential evidence. Based on the findings resulting therefrom, Bettina assists companies in identifying weak spots, laying the foundations for preventing future misconduct and sorting out follow-up issues in the field of criminal law – always focusing on how to protect the company’s reputation in the best way possible.
Bettina is actively involved in Osborne Clarke's pro bono work, leading an initiative to help particularly vulnerable Afghans who are seeking protection in Germany.
Bettina joined Osborne Clarke in 2022 from a leading international law firm, where she practiced as a white-collar lawyer. Prior to her career as a lawyer, Bettina gained extensive experience in academia, focusing on comparative criminal law and interdisciplinary issues. She was appointed as a visiting researcher at University of California, Los Angeles, School of Law and worked at the German embassy in Tel Aviv.
