Placing packaged products on the Polish market is associated with several regulatory obligations. Both producers of products and entities that import packaged products into Poland (e.g. their importers, entities making intra-community acquisitions of packaged products or packaging) are subjects to them.
New is that some of the packaging of food products may be subject to the regulations for single-use plastic products (implementing the so-called SUP Directive), which apply in Poland from May 2023.
SUP regulations mean new responsibilities - both for:
- those introducing food products in certain plastic packaging,
- those introducing certain plastic packaging (e.g. food containers), as well as for
- catering and retail outlets offering takeaway food or beverage products in single-use plastic containers or cups.
Obligations introduced by the SUP regulations include, among others, the need to calculate and pay fees, and keep appropriate records and annual data reporting by BDO.
