The recent report in Planning Magazine on the number of planning appeals for major housing schemes, and success rates, since the introduction of the NPPF in 2012 produces some interesting statistics.

Osborne Clarke's longstanding client, Welbeck Strategic Land, has a 100% success rate at appeal for this period – winning 11 out of 11 appeals.

John Baird, head of Osborne Clarke's Planning Team, who advised Welbeck Strategic Land on these appeals said:

"Welbeck's success at appeal shows the importance of having a robust planning strategy in place from the beginning of the planning process.  As all of us involved in the planning system know, whilst appeals are expensive, time consuming and carry have an inherent risk, there are times when pursuing an appeal is unavoidable.  It is also interesting to note that, of the 11 appeals Welbeck have won, two have been unsuccessfully challenged in the Planning Court by the relevant local authority."

Alistair Watson, Senior Partner, Welbeck Strategic Land, said:

"We consider very carefully the sites we invest in and whilst our preferred and principal planning strategy is to work collaboratively with councils, key stakeholders, and local communities to secure planning permission, this is not always possible. Where an appeal is justified Welbeck has the financial resources, experience and track record to ensure our landowner partners' aspirations are met. It is very pleasing to note our market leading success rate at appeal and hopefully this is one of the many reasons landowners and agents choose to work with Welbeck."
