Oborne Clarke advised SCR Piemonte S.p.A., a limited company wholly owned by the Piedmont Region, established by Regional Law no.19 of 6 August 2007 with the aim of rationalizing public spending and optimizing the procedures for choosing public contractors, in particular in the areas of infrastructures, transports, telecommunications and health, on 2 sets of litigation proceedings before the Regional Administrative Court of Piedmont relating to the centralized regional tender for the supply of sanitary gloves with an overall value of approximately Euro 28 million.
In the first proceedings, accepting the defence presented by Osborne Clarke, the Regional Administrative Court declared the inadmissibility of the application brought against the tender procedure’s documents, and ordered the applicant to pay the costs. In the second proceedings, the same court rejected the request for precautionary measures presented by the applicant, thus allowing the relevant public contract to be entered into. These decisions have therefore allowed the Piedmont and Valle d’Aosta health authorities to obtain supplies of the essential equipment to continue throughout the Covid-19 emergency.
