Payments regulation, employment law consultations, and asset recovery

The government's recent announcement that it will be abolishing the Payment Systems Regulator comes as part of its ongoing stated aim to reduce the regulatory burdens on business and stimulate growth. The impact of this announcement is assessed in our Insight.

A new consultation on mandatory ethnicity and disability pay gap reporting has opened. It will inform proposals in the government's forthcoming Equality (Race and Disability) Bill, announced in the King's Speech. The government has stated that it is "keen to minimise additional burdens on businesses" and therefore intends to use the same processes and systems that are already in place for gender pay gap reporting. Our Insight looks in more detail at the proposal, and at other recent employment law developments (including a green paper seeking views on reforming benefits).

Our update on cross-border enforcement and asset recovery discusses a number of recent court decisions, including on the extra-territorial reach of, proper test for, and breach of freezing orders, the willingness of English courts to grant anti-suit injunctions in support of foreign-seated arbitrations, and more. It also considers how a bill proposing to recognise digital assets as personal property could affect legal certainty and certain equitable defences already available under English law.
